Community Empowerment (Scotland) Act 2015, Part 5: Asset Transfer Requests – Appeal of Decision of the Local Authority to Scottish Ministers.

Dear Lynn,

Thank you for your appeal, and accompanying documents which were received by the Scottish Government on 13 November 2023, requesting an appeal of the decision made by North Lanarkshire Council to refuse the request made by the Viewpark Gardens Trust to lease Viewpark Gardens under Part 5 of the Community Empowerment (Scotland) Act 2015, which concerns Asset Transfer Requests.

An appeal under Section 83(6) of the Community Empowerment (Scotland) Act 2015 has been made in writing in accordance with The Asset Transfer Request (Appeal Where No Contract Concluded) (Scotland) Regulations 2016, by Viewpark Gardens Trust, 80 Juniper Road, Viewpark, Uddingston, Glasgow, G71 5BD.

This letter acknowledges receipt of your appeal on behalf of Viewpark Gardens Trust, and a copy of this letter has been sent to Leanne Pollock, Community Engagement Officer, and Marrya Bashir, Solicitor at North Lanarkshire Council. We will make a copy of the appeal documentation available on the Scottish Government website, and notify you when this has been done.
